Cocone Group Guidelines for the Use of Copyrighted Material

Thank you for using the services of Cocone Group.

Cocone Group, through our services and platforms, aims to facilitate deeper interaction between customers, and aid in stimulating customers' creativity through「inspiration」and「ideas」. We are therefore establishing Guidelines for the Use of Copyrighted Works (hereinafter referred to as 「the Guidelines」).

The Guidelines provide a comprehensive summary of the rules you must follow when creating and publishing derivative works using Cocone Group content (such as videos, still images, and audio). We hope that these Guidelines will enable you to enjoy Cocone Group’s various services more broadly and as part of your daily life.

Please note that the Guidelines apply only to individual customers. They do not apply to derivative works created by corporate or other organizational customers, or to activities conducted as part of the business operations of the organization to which a customer belongs.

【Regarding Rights to Copyrighted Works】
All images, audio, text, logos, and other content published or displayed by Cocone Group across its various services (hereinafter referred to as「the Content」) are protected as copyrighted works of the provider under the Copyright Act. However, Cocone Group will refrain from asserting claims of copyright infringement provided that you comply with the Guidelines.

【Regarding Derivative Works】
Permission to use the Content as source material
Usable content
・The playable character within a service, that serves as an avatar（PC）
・Non-player characters appearing in a service（NPC）
・Content distributed to customers by each service provider

Content Requiring Caution/Non-Usable Content
・Playable characters other than yourself (your own avatar)
If you wish to use a third party’s PC (Player Character) as the subject of your work, you must obtain permission from that third party.
・Collaboration Items, etc.
For information regarding the use of content, including designs and other materials, for which third parties other than the Cocone Group hold rights, please refer to Section 4 of the Terms of Use.

※Please note that creative works featuring motifs related to Cocone Group’s staff or official accounts may also be enjoyed within the scope of the Guidelines, provided they are conducted as unofficial fan activities with moderation and consideration for those involved.

【Regarding AI Generated Content】
Cocone Group views various AI tools, including generative AI, as「tools」that support the「desired expression」(regardless of form, such as text, images, or video), and we do not intend to restrict creative activities simply because they involve AI. Therefore, regardless of whether various AI tools are used, all such works will be treated equally as derivative works and subject to the Guidelines.

Please note that, as stated in the section above titled「Regarding Rights to Copyrighted Works」, the rights to the Content are held by the provider.
Depending on the tool you use, there may be legal issues, such as「the condition of use requiring that the input data be your own intellectual property」, or「the input data becoming the intellectual property of the tool provider」. Please review the Terms of Use or other relevant documents for the tool you intend to use before proceeding.

【Requirements for Usage】
１.Please refrain from using content for commercial purposes
・As a general rule, we prohibit any exchange of money (including cash, in-app currency, and various items) between users arising from this content (except through methods officially provided within the service). You may use the Content solely for personal, non-commercial purposes. Please refrain from using it for commercial or profit-making activities, or for corporations.
・If Cocone Group determines that the use of the Content constitutes commercial or for-profit activity, we may restrict your access to it. In such cases, please comply with our instructions promptly. Failure to do so may result in legal action being taken against you for infringement of our rights.
・If you use the service for personal enjoyment and receive compensation only to cover the cost of materials, this is considered to be within the scope of non-commercial use. For example, if you make a stuffed animal featuring a character from a Cocone Group service and give it to a friend as a gift, there is no issue with accepting payment to cover the cost of materials such as fabric and stuffing.
・If you stream yourself playing a Cocone service, and use the partner features officially provided by the video streaming platform, you can also monetize your content.

２.Please do not damage the service's reputation
・Use of the service that leads to significantly damaging its image, such as content that violates public order, morals, or any applicable laws; or excessively violent, obscene expressions, and conduct lacking in morality as well as decency, is strictly prohibited.
・We also prohibit the use of our services for political activities, religious proselytizing, ethnic discrimination, criticism of specific individuals or groups, hate speech, or similar actions.
・We additionally prohibit the use of our services to defame, slander, or otherwise harm the reputation of specific individuals, such as other customers, as well as engaging in any acts that may lead to such harm. This prohibition also applies to indirect or suggestive use.
・If you use the Content as is, please refrain from making any alterations or edits that significantly distort the Content’s original appearance or purpose.

３.Regarding required disclosures and explanations at the time of disclosure
・When posting derivative works on social media, video-sharing sites, or similar platforms, please be sure to clearly indicate that they are not official by including labels such as「Fan Art (FA)」or「Unofficial」. Any expressions that could be mistaken for official content (such as claiming to be official or prominently displaying official logos) are prohibited.
・If you use an AI tool, please clearly indicate「AI used」.
・Please refrain from making any misleading statements, such as falsely claiming that you have received official cooperation or sponsorship from Cocone Group or a third party.
・When publishing a website featuring any of Cocone Group’s services, please include the following text in a prominent location on the site.

４.Please respect the rights of third parties
・Even for content provided through collaborative initiatives, there are materials owned by other companies or third parties for which Cocone Group does not hold the rights. Cocone Group is unable to provide details regarding these materials, and they are therefore excluded from the scope of the Guidelines. Please verify the terms regarding the use of such materials for derivative works by yourself.

５.Prohibition on modification and redistribution
・You are prohibited from creating compilations or archives by cropping, collecting, or saving images, videos, or other content from the Service, and distributing them as a collection of materials.
・It is prohibited to distribute or provide the Content, including derivative works, as material that third parties may freely use.

６.Other/Detailed Regulations
・Compliance with the Guidelines constitutes a declaration by the Cocone Group that it will not raise any objections. However, such compliance does not constitute a grant of a license to the customer.
・The content of the Guidelines is subject to change without prior notice. Please note that the Cocone Group assumes no liability for any damages resulting from revisions to the Guidelines.
・If there are separate guidelines established for individual services in addition to the Guidelines, and if there is a conflict between their provisions, the provisions of the Guidelines shall take precedence, unless the separate guidelines contain specific provisions to the contrary.
・We will not respond to individual inquiries regarding the Guidelines, or requests for specific licenses. Please use the Guidelines at your own discretion.
・If Cocone Group determines that a post does not comply with the Guidelines, we may request that the operator of the relevant service remove the post without obtaining the user’s consent.
・Cocone Group assumes no responsibility whatsoever for any disputes or issues arising between customers and third parties in connection with customer posts or similar content, except in cases where Cocone Group is found to have acted with intent or gross negligence.
・Cocone Group makes no warranties regarding the content of videos posted by customers, including that such content does not infringe on the rights of third parties.
・Even if a customer suffers any disadvantage or damage as a result of posting content or taking other actions, Cocone Group shall not be held liable in any way for such disadvantages or damages.

【FAQ（Frequently Asked Questions）】

Q１. Is it okay to use screenshots from the service as wallpaper or social media profile pictures?
A. It's fine as long as it's for personal enjoyment.

Q２. Is it okay to create an illustration of my avatar on the service, and print it on items such as stickers, acrylic keychains, or phone cases for personal use, distribution, or display in my room?
A. It's fine as long as it is for personal use and distribution (free of charge).

Q３. Is it okay to print out illustrations created based on the Content, and give them to friends or others as gifts?
A. It's fine as long as it is for personal enjoyment and not for profit.

Q４. Would it be okay if I compiled screenshots of my outfits into a book? 
A. It's fine as long as it is for personal enjoyment and not for profit.

Q５. Is it okay to draw illustrations (copyright mixing) featuring characters from other companies wearing clothes from Cocone Group's services, and post them on social media?
A. Content for which we do not hold the rights is not covered by the Guidelines, and we are unable to provide further details. We kindly ask that you contact the relevant rights holders directly to obtain further information.

Q６. Is it okay to create an illustration combining services provided by Cocone Group, and post it on social media?
A. For example, in cases involving content owned by the Cocone Group, such as「Pokecolo × Livly」, derivative works that span different services are permitted.

Q７. Is it okay to create human-sized clothing based on in-game items and wear them while streaming? I do not sell the clothing.
A. It's fine as long as it's for personal enjoyment.
